Eight weeks in the dark, or eight stages you can name.

Nothing below is unusual. It is what happens on every transfer in South Africa. The only thing a good conveyancer changes is whether you know which stage you are on.

01

Day 1

Instruction

Controlled by Us

The agent sends the signed offer. We check the parties, the price and the property description, and write to both of you the same day.

  • A copy of the offer, with every annexure
  • Both parties get the same list of what we need
  • A file reference to quote on everything after this

Week 1

FICA and documents

Controlled by You

Every party is verified before we may act. This is the stage clients hold up most often and the cheapest one to get right.

  • Identity document or passport, every owner
  • Proof of address under three months old
  • Marriage certificate and antenuptial contract, if any
  • Income tax number — SARS will not assess the duty without it

Weeks 2–8

Rates and levy clearance

Controlled by The municipality

We apply the week we are instructed because it is the longest stage and we cannot shorten it. Sectional title adds a levy clearance from the body corporate.

  • The council quotes several months of rates in advance
  • The seller pays it and is refunded what is not used
  • A disputed municipal account stops the transfer entirely

Weeks 3–5

Transfer duty or VAT

Controlled by SARS

Duty is assessed on the purchase price. Where the seller is a VAT vendor selling in the course of business, VAT applies instead and no duty is payable.

  • Submitted once both parties have signed
  • The receipt must be in hand before lodgement
  • On a new development the price usually includes the VAT

Week 5

Signature

Controlled by Both of you

Buyer and seller sign separately, at our offices, about twenty minutes each. You leave with a copy of everything you signed.

  • The buyer signs the transfer documents and declarations
  • The seller signs the power of attorney to pass transfer
  • Neither of you needs the other in the room

Week 6

Lodgement

Controlled by Three firms

The transfer, the new bond and the cancellation of the seller’s bond are lodged on the same day, linked as one batch.

  • Any one firm not ready holds up the other two
  • A batch short one document is not lodged at all
  • This is the day the registration date becomes predictable

Weeks 7–9

Examination

Controlled by The deeds office

Examiners check every page. Seven to ten working days when the office is running well, longer at the end of a financial year.

  • A note raised on any document sends the batch back
  • Correcting and re-lodging restarts this stage
  • We tell you the day it happens and what caused it

Weeks 8–10

Registration

Controlled by The deeds office

The property transfers into your name and the bond registers against it. The seller is paid the same day or the next working day.

  • We telephone before we email
  • Keys pass on registration unless your offer says otherwise
  • The title deed follows some months later

The bond · your bank's attorney

  1. Bond approved

    Your bank instructs its own attorney

  2. Bond documents signed

    A separate appointment at a separate firm

  3. Cancellation figures

    The seller's existing bond is called up

  4. Bond lodged

    It must go in on the same day as the transfer

Both tracks must be ready on the same morning.

The deeds office registers them together or not at all. One outstanding rates clearance holds up a bond that has been ready for three weeks, and neither firm is obliged to tell you which side the hold-up is on. We tell you, every Friday, in writing.

04What we need from you

Send it all at once and you save a fortnight.

If you are buying

  • Identity document, and your spouse’s if you are married
  • Proof of residential address, under three months old
  • Income tax number
  • Marriage certificate, or antenuptial contract
  • Bond grant letter, once your bank issues it
  • The deposit, into our trust account

If you are selling

  • Identity document, for every registered owner
  • Proof of residential address, under three months old
  • Income tax number
  • The title deed, or the name of the bank holding it
  • Your bond account number, for cancellation figures
  • Electrical, gas, electric fence and beetle certificates

Email them, photographed on a phone, the day you are asked. Every day this list sits incomplete is a day added to the end.
